1. Parties and Scope
These Terms of Use govern the conditions for using the services offered via the fotipoti.com website and application ("Platform"). The Platform is operated by Talha Çoruh ("Fotipoti"). Every visitor and member using the Platform is deemed to have accepted these terms.
2. Description of the Service
Fotipoti is a platform that provides professional photo and video shoot services for businesses' products on a per-order (no-subscription) basis. The customer orders by selecting category, style and format, sends the product to Fotipoti, the shoot is carried out, and the digital content is delivered electronically.
3. Membership
- Providing accurate and current information during registration is mandatory.
- Account security and password confidentiality are the member's responsibility.
- Persons under 18 may not become members or transact.
- Fotipoti reserves the right to suspend or close accounts that violate these terms.
4. Order and Payment
- Prices are shown on the Platform at the time of order and include VAT.
- Payment is made by credit/debit card (PayTR infrastructure) or bank transfer/EFT.
- The order is processed after payment is confirmed.
5. Customer Obligations
- To deliver the product to be shot to Fotipoti within the specified period and conditions.
- To warrant that the products and content sent do not infringe third-party rights (intellectual property, trademark, etc.).
- Not to request shoots for unlawful, misleading or prohibited products.
6. Intellectual Property
- The Platform's design, software, brand and content belong to Fotipoti and may not be used without permission.
- The usage rights to the delivered shoot content are granted to the customer within the scope of the order. Unless otherwise agreed, Fotipoti reserves the right to use the content in its own promotion and portfolio work; the customer may object to such use.
7. Limitation of Liability
- The service is provided "as is"; uninterrupted or error-free operation is not guaranteed.
- Fotipoti cannot be held liable for delay or non-performance in cases of force majeure such as natural disasters, infrastructure or shipping disruptions.
- Fotipoti is not responsible for results arising from incomplete/incorrect information or product delivery on the customer's part.
8. Third-Party Services
The Platform uses third-party service providers for payment (PayTR), shipping, hosting and notifications. The terms of these services apply.
9. Protection of Personal Data
The principles regarding the processing of personal data are set out in the Information Notice and the Cookie Policy.
10. Changes and Effect
Fotipoti may update these terms; the current version takes effect upon publication on the Platform.
11. Dispute Resolution
Turkish law applies to disputes arising from these terms. In consumer transactions, Consumer Arbitration Committees and Consumer Courts have jurisdiction within the statutory monetary limits.
